As of 1st of May 2016, the VAR has lapsed and with it the indemnification of non-remittance of income taxes and social security =ontributions. The VAR is replaced by a Model Agreement, that has been approved by the Dutch tax authorities.
What does this mean for you as a freelancer?
Due to the great uncertainty regarding this law and for the risk of appearing to have an authoritative/supervisory role, many companies might be reluctant to hire freelancers, as independent and result driven assignments are less common than assignments where freelancers often operate in teams under authority/supervision. Moreover, the freelancers are not allowed to be trained nor attend work meetings.
CIMSOLUTIONS has a Model Agreement allowing the indemnification of non-remittance of income taxes and national/employee insurance contributions, reviewed by and incorporating the review comments made by the Dutch tax authorities. Working with a Model Agreement is only possible if the freelancer in question works independently, is free to arrange the activities as he/she sees fit, is not led nor supervised by the client and is allowed the choice of independent replacement.
